4. Intellectual property

Unless otherwise agreed in writing, ownership of work product and deliverables is as stated in your project agreement. We retain rights to our pre-existing materials, tools, and general know-how. Our name, logo, and branding may not be used without permission.

Our services may integrate with third-party platforms. Your use of those services may be subject to the third party's terms. We are not responsible for third-party services we do not control.

6. Disclaimers

Except where prohibited by law, our services are provided "as is" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our aggregate liability for claims arising out of these Terms or our services will not exceed the amounts you paid us for the specific service giving rise to the claim during the twelve (12) months before the claim, or one hundred U.S. dollars (USD $100) if no such payment applies.

8. Indemnity

To the extent permitted by law, you will defend and indemnify us against claims arising from your use of our services, your content, or your violation of these Terms or applicable law.

9. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protections apply in your jurisdiction.
